Agreement

These Terms of Service ("Terms") govern your use of the Presently adaptive signage platform operated by Adaptive Advertisement, Inc. By signing up for or using the service, you agree to these Terms.

The Service

Presently provides a hardware device (the Edge AI Computer Vision player) and associated software platform that enables audience-aware in-store digital signage. The device is provided under a one-time hardware & activation fee plus an ongoing software subscription, and remains the property of Adaptive Advertisement, subject to return, unless you purchase it outright at its MSRP as described below.

Fees and Billing

• Getting started requires a one-time $299 hardware & activation fee, billed immediately at checkout, plus a $79/month software subscription.
• The $299 fee covers the Edge AI Computer Vision player, its camera module, and activation. The $79/month subscription covers the software platform, the cloud CMS dashboard, and support.
• Your subscription is billed monthly in advance and auto-renews each month. You may cancel at any time by emailing [email protected]; we process the cancellation through Stripe, effective at the end of the current billing period.
• Except as provided under the 90-Day Risk-Free Money-Back Guarantee below, no refunds are issued for partial months or for the hardware & activation fee. Your service continues until the end of the current billing period after cancellation.

90-Day Risk-Free Money-Back Guarantee

• Retail pilot customers are covered by a 90-day money-back guarantee that begins on the date your device is delivered.
• To invoke the guarantee, email [email protected] to request cancellation and your prepaid shipping label, and return the device by day 90. Returns postmarked after day 90 are not eligible.
• When we receive an eligible device in good condition (normal wear excepted) by day 90, we cancel your subscription and refund, through Stripe, the full $299 hardware & activation fee and all $79/month subscription payments made during the guarantee period.
• If you keep the device beyond day 90, the guarantee expires and the fees paid become non-refundable. Your subscription continues on the standard monthly terms until cancelled.

Hardware Return and Replacement

• The Presently device remains the property of Adaptive Advertisement for the duration of your subscription. You are responsible for the device while in your possession; damage beyond normal wear may be subject to a replacement fee.
• Upon cancellation, you must return the device within 2 weeks (14 days) using the prepaid shipping label we provide.
• If you cancel and do not return the device within 14 days, you agree to be billed the device's MSRP of $699 per device, at which point the device becomes yours to keep.
• Do not attempt to modify, reverse-engineer, or tamper with the device firmware or enclosure.

Your Content

You retain ownership of all ad content you upload to Presently. By uploading content, you grant Adaptive Advertisement a limited license to store and display it on your behalf through the service.

You are solely responsible for ensuring your content complies with applicable laws, does not infringe third-party rights, and is appropriate for display in your store environment.

Acceptable Use

You may not use Presently to display content that is:

• Illegal, defamatory, or fraudulent
• Sexually explicit or inappropriate for a general retail audience
• Targeted at individuals based on protected characteristics in violation of applicable law

Adaptive Advertisement reserves the right to suspend accounts that violate these restrictions.

Privacy Commitments

Our use of in-store camera data is governed by our Privacy Policy. We commit that no raw camera footage is stored or transmitted. All audience inference is performed locally on the device.

Disclaimers and Limitation of Liability

The service is provided "as is." We do not warrant uninterrupted operation, though we aim for high availability. To the maximum extent permitted by law, Adaptive Advertisement's liability for any claim arising from your use of the service is limited to the amount you paid in the three months preceding the claim.

Governing Law

These Terms are governed by the laws of the State of Colorado, USA, without regard to conflict of law principles.

Changes to These Terms

We may update these Terms. We will notify you of material changes via email at least 14 days before they take effect. Continued use after the effective date constitutes acceptance.
